Last Updated: 10 June 2026  ·  Effective Date: 10 June 2026  ·  Phinai, Bangkok, Thailand

These Terms and Conditions govern your use of this website and your engagement with Phinai for legal services. Please read them carefully. If you have any questions, we are happy to explain anything before you proceed.

1. Definitions

In these Terms and Conditions, the following expressions carry the meanings set out below:

2. Acceptance of Terms

By using this Website or by engaging our Services, you confirm that:

If you do not agree with any part of these Terms, we ask that you refrain from using this Website or engaging our Services. You are always welcome to contact us with any questions before proceeding.

3. Services Described

Phinai provides inheritance legal services in Thailand. Our current services include:

Services are provided primarily to clients in Thailand. Where an international dimension is involved, we will advise you on any limitations or the need for additional specialist input before proceeding.

The information on this Website is for general guidance only and does not constitute legal advice. Formal legal advice is provided only within the scope of a written engagement.

4. Engagement and Instructions

A formal engagement begins when both parties have agreed to a written scope of work or engagement letter. Submitting an enquiry via this Website or making initial contact does not of itself create a client-solicitor relationship.

We ask that all instructions be provided clearly and in good faith. Where instructions relate to the wishes of a third party (for example, a person whose estate is being settled), you confirm that you have the authority to give those instructions.

We may, at our reasonable discretion, decline to act in a matter or to continue an engagement if we determine that doing so would conflict with our professional obligations or with the law.

5. Your Responsibilities

When using this Website or engaging our Services, you agree to:

The quality of the advice and services we provide depends substantially on the accuracy of information you share with us. We are not responsible for outcomes that arise from incomplete or inaccurate information.

6. Fees and Payment

Our current service fees are published on the Services page of this Website. Fees are stated in Thai Baht (฿) and are inclusive of any applicable taxes unless otherwise noted.

Payment terms and methods will be confirmed in your engagement letter. We typically request payment before or at the time of the relevant service step. We will always explain our fees clearly before you commit to any service.

Where unforeseen complexity arises during a matter, we will discuss any potential adjustment to fees with you openly and in advance. We do not apply charges without your knowledge.

Refunds are considered on a case-by-case basis, taking into account the work already completed and the circumstances of your request. Please contact us at [email protected] if you have a concern about fees.

7. Confidentiality

We treat all information shared with us in connection with your matter as strictly confidential. We will not disclose personal or matter-specific information to any third party without your consent, except where required by law, court order, or our professional regulatory obligations.

Our approach to collecting and handling personal data is set out in our Privacy Policy, which forms part of these Terms.

8. Intellectual Property

All content on this Website — including text, layout, design, and documentation — is the property of Phinai or is used with permission. It is protected under applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to view and use this Website for your personal, non-commercial purposes. You may not copy, reproduce, distribute, or publish any content from this Website without our prior written consent.

Documents we prepare on your behalf as part of a formal engagement are provided to you for your own lawful use in connection with your matter.

9. Disclaimers

This Website and its content are provided in good faith and to the best of our knowledge. However:

10. Limitation of Liability

To the extent permitted by Thai law, Phinai's total liability to you in connection with any engagement or use of this Website shall not exceed the fees paid by you for the specific service to which the claim relates.

We are not liable for indirect, consequential, or incidental losses arising from your use of this Website or our Services, including but not limited to loss of opportunity, loss of anticipated savings, or third-party claims — except where such liability cannot be excluded by law.

Nothing in these Terms limits our liability for fraud, personal injury caused by our negligence, or any other liability that cannot be excluded under Thai law.

11. Indemnification

You agree to indemnify Phinai and its associates against any claims, losses, or expenses arising from your breach of these Terms, your provision of inaccurate information, or your misuse of this Website, to the extent that such loss is directly attributable to your conduct.

12. Termination

Either party may bring an engagement to a close with reasonable notice. If you wish to cease our services during an ongoing matter, please contact us so that we can discuss any outstanding steps and ensure your documents are properly returned or transferred.

We may suspend or terminate an engagement where professional obligations require it, where fees remain unpaid after a reasonable period, or where continuing would not be in the interests of the matter. We will communicate any such decision clearly and with appropriate notice.

Provisions relating to confidentiality, intellectual property, limitation of liability, and dispute resolution survive any termination of these Terms.

13. Dispute Resolution

These Terms and any Agreement formed under them are governed by the laws of the Kingdom of Thailand.

If a disagreement arises, we ask that you contact us in the first instance so that we may seek to resolve the matter informally. We take all concerns seriously and will respond promptly.

If informal resolution is not achieved within 30 days, either party may refer the matter to mediation or to the competent courts of Bangkok, Thailand, which shall have exclusive jurisdiction.

14. General Provisions

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or applicable law. When we do, we will revise the "Last Updated" date at the top. We encourage you to review these Terms periodically.

Continued use of this Website or our Services following the publication of updated Terms constitutes your acceptance of the revised version. If you have an existing engagement at the time of any material change, we will bring it to your attention directly.
